En octubre de 1938, pocos meses antes de la ocupación franquista de Cataluña, se celebró en Barcelona uno de los juicios más polémicos de la guerra civil. El Tribunal de Espionaje y Alta Traición de la República juzgaba a la dirección del Partido Obrero de Unificación Marxista, la organización comunista y antiestalinista, a quien el fiscal acusaba de ser una organización al servicio de Franco y del fascismo internacional. Ante la debilidad de las pruebas –en el juicio se demostró que eran burdas falsificaciones que no resistieron el más mínimo análisis– el Tribunal rechazó la acusación. De hecho todo había sido un montaje surgido desde Moscú y de la Internacional Comunista para justificar la dura represión a que estaba siendo sometido el POUM desde mayo de 1937, y que había culminado en el asesinato de su máximo dirigente Andreu Nin.
